These Auction Terms and Conditions (“Auction Terms”) set forth the terms by which you may bid for the Product to which these Auction Terms are linked and incorporates by reference all terms and conditions of the Terms of Service found on the FewoWorld website (the “Terms of Service”). Please read these Auction Terms carefully before submitting any Bid (as defined below) for a Product. By submitting a Bid (defined below), you agree to be legally bound by these Auction Terms. Any capitalized term used but not defined herein shall have the meaning ascribed to such term in the Terms of Service. 

1. AUCTION INFORMATION. 
1. Bidding. You may send an email to the email address provided on a Product listing containing the amount that you wish to pay for the Product (a “Bid”). Users may place a reasonable number of Bids for a Product before the auction closes. Users who wish to bid for multiple Products must indicate how much they are willing to pay for each Product, and each amount will be deemed a separate Bid for each Product.
2. Blind Auction. This auction is a blind auction. In a blind auction no one can see anyone else’s Bids. When the auction goes live, Users can see the Product that is being offered and must decide what they are willing to pay for it without viewing any other User’s bid.
3. Winner. At the end of the auction, the User who placed the highest Bid will be deemed the winner of the auction (the “Winner”). If two or more Users placed a Bid for the same amount, the User with the earlier Bid will be deemed the Winner. At the close of the auction, FewoWorld will determine the winning Bid, and notify the Winner of their purchase as soon as practicable. Once the Winner is notified, the Winner will be charged the amount included in the User’s highest Bid for the Product.
4. Reservation of Rights. FewoWorld reserves the right to: (i) limit the amount of Product it sells to each User, regardless of the User’s Bid, and the amount of Product that the User has requested to purchase; (ii) cancel an auction at any time for any reason or no reason; (iii) sell any amount of a Product, regardless of quantity listed for sale; (iv) not sell to any User, regardless of whether such User is the Winner, in FewoWorld’s sole discretion; and (v) ban any User that FewoWorld suspects to have evaded, or to have attempted to evade, any rules applicable to a particular auction.
2. Purchase Information. When you place a Bid for the Product, you may be required to provide certain information, such as your address and billing information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. FewoWorld shall have no responsibility or liability for inaccurate information or information that later becomes outdated and shall have no obligation to make efforts to determine the correct contact or shipping information. 
3. Payment. If you are the Winner of the auction, you will be charged the amount indicated in your highest Bid for the Product, including any applicable taxes and shipping charges, (the “Purchase Price”) at the time you are charged for the Product. Your placing of a Bid constitutes your express agreement for FewoWorld to charge your provided payment method at the close of an auction. 
4. Shipping. The Product is expected to be ready to ship within 7 days of the close of an auction or as otherwise stated in the Purchase Terms posted with the auction (the “Estimated Shipment Date”). If the Product will not be available to ship by the Estimated Shipment Date, 16 CFR Part 435 rules (the “FTC Rules”) require FewoWorld to offer you the choice of either a refund or to wait until a new expected ship date. 5. No cancellation/refund. At the close of an auction in which you are deemed the Winner, an Order will be created. The Order is final, noncancelable, and nonrefundable, except as specified in the Terms of Service and in the FTC Rules incorporated herein by reference.
6. Disclaimer. Except as expressly provided in the Terms of Service, and to the maximum extent permitted by applicable law, the Product is provided “as is” and “as available,” without guaranteed warranty of any kind. 
7. Limitation of Liability. To the extent not prohibited by applicable law, in no event shall FewoWorld be liable for personal injury, or any incidental, special, indirect or consequential damages whatsoever, arising out of your purchase of a Product or these Auction Terms. Some jurisdictions do not allow the limitation of liability for personal injury, or of incidental or consequential damages, so this limitation may not apply to you. In no event shall FewoWorld’s total liability to you for all damages (other than as may be required by applicable law) exceed the Purchase Price. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.
